01About these terms
These Terms & Conditions govern your use of www.meddentit.com.au (the website), operated by Meddent IT Pty Ltd (Meddent IT, we, us or our).
By accessing or using the website you agree to be bound by these terms. If you do not agree, please do not use the site.
These terms apply to this website only. They are not the terms of service for our platforms, and they are not the contract for any consulting or development work — see Our products and services have their own terms below.
02Who we are
Meddent IT Pty Ltd is an Australian software company. We build and operate SyncStaff, Local Health Care and Book My Chair, and we provide custom software development and IT consulting to other businesses. You can reach us at [email protected].
03Using this website
You may view, browse and print pages of this website for your own personal or internal business use, and to evaluate whether to engage us. We grant you a limited, non-exclusive, non-transferable and revocable licence to do so.
You must not:
- use the website for any unlawful purpose, or in breach of any applicable law;
- copy, reproduce, republish, sell or commercially exploit any part of the website except as these terms allow;
- attempt to gain unauthorised access to the website, its servers or any connected system, or probe, scan or test its security;
- introduce any virus, malware or other harmful code, or take any action that imposes an unreasonable load on our infrastructure;
- scrape, harvest or systematically extract content or data from the website, or use it to train a machine learning model, without our prior written consent;
- frame or mirror the website, or remove or obscure any proprietary notice on it; or
- impersonate any person or misrepresent your association with any person or organisation.
You are responsible for your own internet access, device and security arrangements, and for anything done through the website using your connection.
04Our products and services have their own terms
The pages describing SyncStaff, Local Health Care and Book My Chair on this website are marketing material. They are a summary, not a specification, and they are not an offer capable of acceptance.
Use of any of those platforms is governed by the terms of service and privacy policy published on that platform’s own website, which you agree to when you create an account there. Where those terms differ from these, those terms prevail for that platform.
Consulting, development, hosting and support work is governed by the separate written proposal, quote or services agreement we sign with you. Nothing on this website forms part of that contract, and no engagement begins until it is agreed in writing.
05Enquiries you send us
When you submit the enquiry form or email us, you agree that the information you provide is accurate and that you are entitled to provide it.
Please do not send confidential, sensitive or health information through the enquiry form. It is not a secure channel and it is not a clinical system. If a matter is confidential, tell us and we will arrange an appropriate way to receive it.
Sending us an enquiry does not create a client relationship, an engagement or any obligation on us to respond, quote or accept work. If you send us an unsolicited idea, suggestion or feedback about our products, we may use it without restriction, without any obligation to you and without payment.
We handle the information you send us in accordance with our Privacy Policy.
06Information on this website is general only
The content of this website is provided for general information. It is not medical, clinical, legal, financial, tax or other professional advice, and it does not take account of your particular circumstances, systems or obligations.
Any reference to Medicare, compliance, privacy or regulatory matters is a general description of what our software is designed to support. It is not advice that you will meet any particular obligation, and it does not replace advice from your own qualified adviser. You should obtain your own professional advice before acting on anything you read here.
We try to keep the website accurate and current, but we do not warrant that it is free from error or omission, or that any figure, feature or description remains current. Features described here may change.
07Intellectual property
All content on this website — including text, graphics, layout, design, code, logos, product names and images — is owned by Meddent IT Pty Ltd or used under licence, and is protected by the Copyright Act 1968 (Cth) and other laws.
“Meddent IT”, “SyncStaff”, “Local Health Care” and “Book My Chair”, together with our logos and branding, are our trade marks. You must not use them without our prior written permission.
Except as permitted under the Copyright Act 1968 (Cth) or by these terms, you must not reproduce, adapt, distribute, publish or create derivative works from any part of this website without our written consent. Any third-party names or marks appearing on the website remain the property of their respective owners.
08Availability of the website
We provide this website on an “as is” and “as available” basis. We do not guarantee that it will be available without interruption, that it will be free of errors or defects, or that it or the server that makes it available is free of viruses. We may change, suspend, restrict or withdraw the website, or any part of it, at any time and without notice.
09Links to other websites
The website contains links to sites operated by others, including the sites for our own platforms. We provide those links for convenience only. We do not control, endorse or accept responsibility for the content, products, services or privacy practices of any linked site, and a link does not imply any association with its operator. You follow those links at your own risk.
10Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or under any other law, where doing so would be unlawful.
Where a statutory guarantee applies and cannot lawfully be excluded, but we are permitted to limit our liability for breaching it, our liability is limited — at our option — to resupplying the services or paying the cost of having them resupplied.
The disclaimers and limitations in the next two clauses apply only to the extent the law permits, and are read subject to this clause.
11Disclaimers
To the maximum extent permitted by law, and subject to the Australian Consumer Lawclause above, we exclude all representations, warranties, guarantees and conditions relating to this website and its content that are not expressly set out in these terms, whether implied by statute, custom or otherwise — including as to accuracy, completeness, currency, fitness for a particular purpose, merchantability and non-infringement.
12Limitation of liability
To the maximum extent permitted by law, and subject to the Australian Consumer Law clause above:
- we are not liable to you for any loss or damage of any kind arising out of or in connection with your use of, or inability to use, this website or anything linked from it, however arising, whether in contract, tort (including negligence), statute or otherwise; and
- we are not liable for any indirect, special, incidental or consequential loss, or for any loss of profit, revenue, goodwill, business opportunity, data or anticipated savings, even if the possibility of that loss was known to us.
Where liability cannot be excluded, our total aggregate liability arising out of or in connection with this website is limited to one hundred Australian dollars (AUD $100).
This clause does not limit any liability we have under a separate signed services agreement or platform terms of service — those documents contain their own liability provisions and govern that relationship.
13Indemnity
You indemnify us, and our officers, employees and contractors, against any claim, loss, liability, cost or expense (including reasonable legal costs) arising from your breach of these terms, your misuse of the website, or your infringement of the rights of any other person — except to the extent it was caused by our own negligence or wrongful act.
14Privacy
Our Privacy Policy explains how we collect, use, store and disclose personal information through this website, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. It forms part of these terms, and by using the website you agree to it.
15Suspending access
We may restrict or block your access to the website at any time, without notice, if we reasonably believe you have breached these terms or that your use threatens the security, integrity or availability of the site. The clauses concerning intellectual property, disclaimers, liability, indemnity and governing law survive any such restriction and any discontinuation of the website.
16Governing law
These terms are governed by the laws of Western Australia, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia and the courts able to hear appeals from them. If any provision of these terms is found to be invalid or unenforceable, it is severed and the remaining provisions continue in full force.
17Changes to these terms
We may update these terms from time to time. The current version is always published on this page, and the “last updated” date at the top tells you when it last changed. Changes take effect when published, and continuing to use the website after that means you accept them. Please check this page from time to time.
